Terms of Use
These terms are an agreement between you and DBR for the DailyCalo app, the dailycalo.vn website and related services.
1. Acceptance
By creating an account or using DailyCalo you confirm you have read and agree to these terms and the Privacy Policy. DailyCalo is developed and operated by DBR (an independent developer without a separately registered legal entity).
2. Eligibility
You must be at least 16. You provide accurate information, keep your password confidential and are responsible for activity on your account. One account per person.
3. DailyCalo is not a medical service
DailyCalo is a nutrition and training tracker. The app, the AI assistant David and estimated figures (calories, macros, BMR, TDEE, targets) are for reference only; they are not diagnosis, treatment or medical advice and do not replace a doctor, pharmacist or dietitian. Photo-based estimates can be significantly off. If you have a medical condition (diabetes, heart or kidney disease…), are pregnant or breastfeeding, have a history of eating disorders, or want to lose or gain weight fast or take supplements, talk to a doctor before changing your diet or training. Stop exercising and seek medical care if you feel chest pain, dizziness, shortness of breath or get injured; in an emergency call your local emergency number (115 in Vietnam).
4. AI assistant
David is an artificial-intelligence system, not a person. When you agree to use AI features, relevant data (photos, messages, the log figures needed) is sent to AI providers as described in the Privacy Policy. Answers may be incomplete or wrong. David can add, edit or delete log entries at your request and always shows a label for each action; please check them. Do not enter unnecessary sensitive information.
5. Your content and community rules
You are responsible for what you post. DailyCalo has zero tolerance for objectionable content or abusive users. Do not post unlawful, sexual, violent, hateful, harassing, bullying, fraudulent or infringing content, or content that violates privacy (including photos or clips of others without permission); do not promote drugs, banned substances or extreme weight-loss methods; do not post false reviews.
You can report posts, comments and users and block users right in the app. We review reports and remove offending content and suspend offending accounts within 24 hours.
6. PT / expert services
DailyCalo connects trainees with PTs and experts. PTs are independent service providers, not employees or agents of DBR; we do not guarantee any PT’s quality, results or qualifications, even with a “verified” mark (which only means basic information was checked under our process). A PT can see your data only after you connect and the PT accepts; you can disconnect at any time. PTs must not diagnose, prescribe or give medical directions through the platform.
7. Payments, fees and cancellations
PT services (single sessions, session packs, monthly coaching) are paid through the MoMo wallet. Prices are set by the PT and shown before you pay; DailyCalo keeps a platform fee (currently 10%) from the PT’s share, not added to your price. Cancelling a booked session at least 12 hours before it starts returns the session to you; cancelling later forfeits it, unless the PT agrees otherwise or the law provides otherwise. We do not store card or wallet details. Payment complaints: hello@dailycalo.vn.
8. Prohibited conduct
- Unauthorised access, vulnerability scanning, interfering with the system or other people’s data; mass scraping.
- Impersonation, posing as a PT or expert, fraud.
- Reverse-engineering, copying or redistributing the app.
- Using the app for advertising, spam or unauthorised selling.
- Breaking Vietnamese law, including cybersecurity, advertising and e-commerce rules.
9. Intellectual property
The DailyCalo name, logo, interface, source code and materials belong to DBR or its licensors. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app under these terms. Content you create remains yours; you allow us to store, process and display it solely to operate the service.
10. Privacy
Personal data is handled under the Privacy Policy, which forms part of these terms.
11. Suspension and termination
You can delete your account at any time in Me → Delete account. We may suspend or terminate accounts that breach these terms, endanger others or the system, or at the request of a competent authority; except in emergencies we will give notice where possible.
12. Limitation of liability
To the extent permitted by law the service is provided “as is”; we do not warrant it will be uninterrupted or error-free. We are not liable for indirect damages, or data loss caused by your device, network or actions; our total liability (if any) will not exceed what you paid through DailyCalo in the previous 12 months. This does not limit liability that cannot be excluded by law, including consumer-protection law, or that arises from our wilful misconduct or gross negligence.
13. Apps downloaded from the App Store
These terms are between you and DBR, not Apple. Apple is not responsible for the app or its content, warranty, support, maintenance or any claims relating to it. Apple’s standard Licensed Application End User License Agreement applies alongside these terms; Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
14. Governing law and disputes
These terms are governed by the laws of Vietnam. Disputes are first resolved by negotiation; failing that, the competent court in Vietnam has jurisdiction. Your mandatory consumer rights are not limited by these terms.
15. Changes
When these terms change we update the date at the top and tell you in the app or by email before material changes take effect. Continuing to use the service after the effective date means you accept the new version, unless the law requires renewed consent.
